Boies Schiller Flexner filed a class action lawsuit against Google in 2020 for $5 billion for an invasion of privacy. AP reports that Flexner claimed he was misled to think that Google didnt’ track its users while using Incognito mode. Google revealed that they had tracked over 136 million people who had used Incognito mode.
The settlement also included that Google had to destroy the records of all Incognito users before the settlement was awarded. This includes billions of records used for personalized advertising. Google also changed its Incognito mode home screen to add more warnings. Moreover, the tech conglomerate has made it clear that they would not be handing out any individual compensation for any damages. However, the court ruled that Google would not be shielded from any future suits that were covered by this lawsuit.
